En Problemas Policias de Investigacion de Tlaxcala por Privacion Ilegal de la Libertad - 20 Nov 2021 07:53

En dias pasados fue muy sonado el tema de unos policias de investigacion de Tlaxcala que detuvieron ilegalmente a un sujeto que circulaba sobre la carretera Tlaxcala-Puebla.
Y se preguntaran ¿En que quedo todo esto?
Despues de promover un amparo federal, la Juez Septimo de Control y de Juicio Oral del Distrito Judicial de Guridi y Alcocer les nego el amparo y proteccion de la justicia pero al solicitar la revision resolvio el Pleno del Primer Tribunal Colegiado del Vigesimo Octavo Circuito, por unanimidad de votos de los Magistrados Nicolas Castillo Martinez, Jesus Eduardo Hernandez Fonseca y Myriam del Perpetuo Socorro Rodriguez Jara, siendo presidente el primero y ponente el segundo de los nombrados, y ampararon al sujeto, encontrando irregularidades en todo el procedimiento, desde la detencion, pasando por MP, Juez de Control y Juez de Distrito.
En este caso se llego a la sentencia de que la detencion fue ilegal y habia 3 horas de desfase desde la detencion hasta la puesta a disposicion, cayendo en el delito de privacion ilegal de la libertad la cual para servidores publicos tiene una pena de hasta 8 anos de prision sin derecho a fianza y ahora el presidente del tribunal solicito dar vista al Ministerio Publico de la Federacion para girar ordenes de aprehension en contra de los responsables.
V. TRAMITE. El Presidente de este Tribunal Colegiado, en proveido de siete de julio siguiente, registro el citado medio de impugnacion con el expediente 128/2021, lo admitio a tramite y ordeno dar vista a la Agente del Ministerio Publico de la Federacion adscrita (fojas 14 a 16 idem).
c) Es evidente que debido a las conductas con probable apariencia de delito desplegadas por el recurrente en la persecucion de la que fue objeto, se justifica (sic) la demora ocurrida entre las dieciocho horas con veintidos minutos y las diecinueve horas con veinte minutos para llegar a la Procuraduria que es el recinto donde se ubica la autoridad competente, es decir, las tres horas que el recurrente estuvo restringido de su libertad sin motivo alguno, o al menos dicho motivo no fue justificado y senalado por la representacion social, violando el debido proceso reconocido en la Carta Magna Federal y en diversos tratados internacionales, ya que la referida puesta a disposicion debe ser de forma inmediata o justificable la demora, sin embargo esto no ocurrio.
Esto nos lleva a la pregunta ¿A manos de quien tenemos encomendada la justicia?
En estos momentos la FGR fue notificada por el presidente del tribunal para que de seguimiento a esta Revision Penal y gire la ordenes de aprehension hacia los o las involucrados por el delito antes senalado.
Esperemos que la nueva Gobernadora del Estado de Tlaxcala Lorena Cuellar Cisneros no siga la linea de venganza y persecucion hacia los ciudadanos y depure la Fiscalia Del Estado de elementos que sin estudios y sin escrupulos estan impartiendo la ley a diestra y siniestra.
Se le hace una invitacion a la nueva Gobernadora del Estado a empezar por los elementos que obran en esta carpeta por los delitos de privacion ilegal de la libertad y los cuales llevan por nombre los siguientes:

- Eduardo Licurgo Mendieta Morales
- Jesus Schiaffini Pineiro
- Jose de Jesus Islas Romero
- Jose Luis Flores Gonzalez
- David Mejia Morales
Se hace un atento llamado a la Fiscalia General de la Republica a dar seguimiento oportuno y eficaz por el delito antes senalado.
